Labour law | Covid-19 – Think about the updating of  The Risk Assessment Document “Document Unique d'Évaluation des Risques” (DUER)Work instructions must be permanently adapted to the circumstances and employees must be made aware of them.

Facing the health emergency generated by Covid-19, the Ministry of Labour stated that “the updating of the “Risk Assessment Document” provided for in Article R. 4121-2 of the Labour Code is mandatory (…)“.

The Ministry also reminded to the employers their obligation to assess risks in order to ensure the safety and protect the physical and mental health of their workers.

In the event of failure to comply this obligation to prevent occupational risks, employers would risk to see their responsibility engaged.

However, the employee also has a responsibility. Indeed, each employee must “take care, according to his training and his possibilities, of his health and safety as well as those of other persons concerned by his acts or omissions at work” (Article L. 4122-1 of the Labour Code).
